Electrical Construction Business Act Compliance in Korea: A Guide

Electrical Construction Business Act administration in Korea covers the back-office compliance that keeps an electrical contracting business running smoothly: reporting changes to registered particulars, reporting construction performance, managing electrical construction engineers, and reporting and responding to violations of the Electrical Construction Business Act (전기공사업법). It is not site work, but a missed deadline can lead to administrative penalties or a lower construction capability rating, so it needs to be tracked on an annual calendar. This guide sets out the procedure and statutory deadlines for each of the four tasks.

Common Pre-Review Checks

Most of this work is filed with the designated contractors’ association (지정공사업자단체) — the association established with approval from the Minister of Trade, Industry and Energy under Article 25 of the Act, namely the Korea Electrical Contractors Association (한국전기공사협회). Registration changes, performance reports and engineer career records are processed through it. Before starting, review the Act, its Enforcement Decree and Enforcement Rules, the Electricity Business Act, the Electrical Construction Financial Cooperative Act, and the association’s registration management guidelines and operating rules, and have a computer and document software ready.

Key Statutory Deadlines

TaskDeadline
Report of change to registered particularsWithin 30 days of the change
Construction performance reportFebruary 15 each year
Financial statements — corporationsApril 10 each year
Financial statements — individualsJune 10 each year
Financial statements — businesses subject to tax filing verification (성실신고확인대상)June 30 each year

If a deadline falls on a weekend or public holiday, follow the association’s notice. Performance and financial data feed the construction capability rating, so build an annual calendar at the start of the year.

1. Reporting Changes to Registered Particulars

  1. Keep the legally registered particulars under constant review and identify any changes. Under Article 7 of the Enforcement Decree these are the trade name, office location, representative, capital and electrical construction engineers.
  2. When a particular changes, first apply for the change with the relevant agencies — for example the corporate register, business registration and social insurance records.
  3. Submit the documents and evidence of the change to the designated association.
  4. With the required evidence for the registration standards in hand, file with the designated association within the statutory period (30 days from the change).

If changes at other agencies are slow, the evidence needed for the association filing arrives late and the 30-day window is easily missed. When a change of representative or office move is planned, work backwards from the corporate and business registration timetable.

2. Construction Performance Reporting

  1. Review the electrical construction contracts and select the projects to include in the performance report.
  2. Prepare the statutory certificate recording construction performance and obtain approval from the client.
  3. Collect the certificates and supporting documents prepared under the Act, and check for typos and data entry errors.
  4. Submit the performance certificates, supporting documents and financial statements to the designated association by the statutory deadline.

The supporting documents for the performance report are set out in Article 18 of the Enforcement Rules. Client approvals take time, so obtain them during the year as projects are completed rather than in February. Completion paperwork is covered in Electrical Construction Completion Management.

3. Electrical Construction Engineer Management

  1. Track the grade and career history of each electrical construction engineer.
  2. Collect the evidence needed to update engineers’ career records and grades.
  3. Make sure engineers and construction managers (시공관리책임자) attend mandatory training.
  4. Apply to the designated association for career and grade changes.

The documents for engineer recognition are set out in Article 12-2 of the Enforcement Rules. Because engineers are part of the registration standards, any resignation or new hire should be checked against both the engineer records and the change-of-registration requirement.

4. Responding to Violations

  1. If a bid notice violates the separate-procurement rule for electrical work (분리발주), collect the evidence, notify the designated body and request action.
  2. If a business that is not a registered electrical contractor advertises itself as one, or uses signage that could be mistaken for one, photograph it on site, notify the designated body and request action.
  3. Install signs or signboards at the site and after completion showing the contractor, the nature of the work and other statutory particulars.
  4. Identify potential violations of the Act in advance and respond.

When the association asks for corrections, identify the errors and resubmit. Evidence is what makes a violation report work, so keep a copy of the bid notice and record the date, time and location of any photos.

FAQ

How soon must a change of trade name or representative be reported?

Within 30 days of the change, to the designated association. Finish the changes at the corporate and business registries first so the evidence is ready.

When is the construction performance report due?

February 15 each year. If it falls on a weekend or public holiday, follow the association’s notice.

When are financial statements due?

April 10 for corporations, June 10 for individuals, and June 30 for businesses subject to tax filing verification. Weekend and holiday dates follow the association’s notice.

What should I do about an unregistered business advertising as an electrical contractor?

Collect evidence such as on-site photos, notify the designated body and request action. Recording the date, time and location helps the case.

Summary

The most common mistake in Electrical Construction Business Act administration is working out the deadline only after something happens. Change reports are due within 30 days, performance reports by February 15, and financial statements in April or June — put them on the annual calendar in advance, and always check engineer changes and registration changes together. The contract records behind the performance report are covered in Electrical Construction Contract Management. A Korean version of this guide is available here.

Actual work must follow applicable standards and the judgment of qualified professionals; always confirm specific values, deadlines and criteria against the latest regulations.
